EQ-i Terms & Conditions

1. Introduction
These terms and conditions (“Terms”) govern the use of the EQ-i (“the Service”) provided by Perform Partners (“the Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Service.

2. Service Description
The Service focuses on benchmarking your emotional intelligence (EQ) through assessments and providing developmental support via our in-house team of qualified practitioners. The Service is intended for personal and professional development purposes only.

  • Third-Party Tool: The emotional intelligence assessments tool used to facilitate the coaching are provided by a third-party company, Multi Health Systems (MHS). All assessment data will be stored and processed through their platform in accordance with their own privacy and data security policies. By using the Service, you agree to the storage of your assessment data by MHS.

3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you have the legal authority to agree to these Terms.

4. User Obligations
By using the Service, you agree to:

  • Provide accurate and complete information during registration and throughout your use of the Service.
  • Use the Service solely for personal or professional development and not for any unlawful or malicious purposes.
  • Not impersonate another person or entity or misrepresent your affiliation with any person or entity.

5. Privacy and Data Protection
We are committed to protecting your privacy and personal data. Any information you provide will be used in accordance with our Privacy Policy, which is incorporated by reference into these Terms.

  • Data Collection: We collect and process personal information (such as assessment results and developmental progress) to provide the Service. Assessment data is stored and processed by Multi Health Systems (MHS), the provider of the emotional intelligence assessment tool. You are also subject to their privacy and data protection policies, which can be found on the MHS Privacy Policy.
  • Data Usage: Your personal data will be used for the purposes of delivering the Service, improving our offerings, and ensuring compliance with applicable legal requirements. MHS may use anonymised or aggregated data for research and analytical purposes.
  • Data Security: While we implement industry-standard security measures to protect your data, the security of data processed and stored by MHS is governed by their own protocols. We recommend reviewing their privacy and data protection policies.
  • Third-Party Data Processors: In addition to MHS, we may use other third-party providers for data storage and processing, ensuring that these parties comply with applicable data protection laws, including GDPR (if applicable).

6. Intellectual Property
All content provided through the Service, including but not limited to assessments, reports, tools, and resources, is the intellectual property of Perform Partners, Multi Health Systems (MHS), or their licensors. You are granted a limited, non-exclusive, non-transferable license to use this content for your personal development.

  • Prohibited Uses: You may not copy, distribute, modify, or create derivative works based on any content from the Service without express written permission from Perform Partners or MHS, as applicable.

7. Practitioner Network and Coaching Sessions
We provide access to our in-house team of qualified practitioners for support in developing your emotional intelligence. While we conduct vetting and training to ensure high standards, Perform Partners makes no representations or warranties regarding specific outcomes or results of the coaching.

  • Coaching Sessions: All coaching sessions will be conducted online. It is your responsibility to ensure you have a stable internet connection and the necessary software or applications installed to participate in these sessions. Perform Partners will not be liable for technical issues on your end that prevent participation in a scheduled session.
  • Confidentiality of Coaching Conversations: Coaching conversations between you and our practitioners are treated as confidential and adhere to the ethical guidelines set out by the British Psychological Society (BPS). However, confidentiality may be breached if there is an indication of harm to: Yourself (the individual), The Practitioner, or Your company or organisation.

In such situations, the Practitioner is obligated to take appropriate action, which may involve reporting to relevant authorities or informing your company.

  • Disclaimer: While our practitioners strive to offer expert guidance and support, Perform Partners is not responsible for the actions, omissions, or outcomes resulting from your engagement with our in-house practitioners. Any decisions or actions you take based on their advice are solely your responsibility.

8. Rescheduling Coaching Sessions
If you need to reschedule a coaching session, you must provide at least 2 working days’ notice to your practitioner. Failure to provide sufficient notice may result in the session being forfeited without refund. Our practitioners will do their best to accommodate rescheduling requests, but we cannot guarantee availability outside the agreed-upon schedule.

9. Limitations of Liability
To the fullest extent permitted by law:

  • The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
  • Perform Partners disclaims any liability for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Service.
  • Perform Partners is not liable for any actions you take based on the advice, guidance, or recommendations provided by our in-house team of practitioners or through the emotional intelligence assessments and tools. Any decisions or actions you take based on such advice are solely your responsibility.
  • While our practitioners strive to provide expert advice and developmental support, Perform Partners will not be held responsible for the outcomes or consequences of any coaching, advice, or assessments provided by our team or the emotional intelligence tools from Multi Health Systems (MHS).

10. Invoice and Payment Terms

  • Payment Requirement: All invoices must be paid in full before the assessment link is provided. Perform Partners will not issue the assessment link until payment has been received.
  • Invoice Expiry: Invoices are valid for 30 calendar days from the date of issue. If payment is not received within this period, the invoice will expire, and a new order will need to be placed to receive the assessment link.
  • Invoice Delivery: Invoices will be sent within 2 working days of placing an order.

11. Invalid Survey Outputs
The emotional intelligence assessments and benchmarking tools provided through the Service, including those provided by MHS, are intended to offer insight into your emotional intelligence. They do not constitute psychological or medical advice, and the results may vary from individual to individual.

  • Invalid Survey Outputs: In the event that the data from your assessment is deemed “invalid” by the assessment tool, whether due to incomplete responses, contradictory answers, or any other factors that affect the reliability of the results, Perform Partners reserves the right to invalidate the product or report. You will not be entitled to a refund in such cases. We encourage you to answer all questions thoughtfully and accurately to avoid invalid results.

12. Assessment Completion Expiration
Once you receive the link to the emotional intelligence assessment, you must complete it within 60 calendar days. If the assessment is not completed within this timeframe, it will expire, and you will no longer be able to access or submit your results. No refunds or extensions will be provided for expired assessments.

13. Cancellation and Refund Policy
Refunds are not provided once the assessment has been completed, even if the output is deemed “invalid” as outlined in Clause 11.

14. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or if your continued use of the Service may expose us to legal or operational risks.

15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms shall be resolved in the courts of London, United Kingdom.

16. Amendments
We may amend these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
